Terms and Conditions

These Terms and Conditions (“Terms”) constitute a legally binding agreement between NSL Nutrition (Naama Sahar Levitt Nutrition), a private company registered in Israel (Company ID: 313558694) (“NSL Nutrition”, “we”, “us”, or “our”), and you (“you” or “your”) governing your access to and use of the SmartEat app (“Service”). By using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

Acknowledgment of Terms

By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. You represent that you have the legal capacity to enter into this agreement or, if you are a minor, that your parent or guardian has consented on your behalf.

Eligibility & Age

You must be at least 17 years old (or the minimum age of digital consent in Israel) to use the Service. Users aged 17 require parental or guardian consent.

Purpose

The Service is designed to support personal health, fitness, and wellness through health tracking, personalized insights, and recommendations. The content is for informational purposes only, intended for personal, non-commercial use, and must comply with these Terms and applicable laws.

Registration

You agree to provide accurate information (e.g., email, phone number) during registration and to update any changes promptly by contacting [email protected]. You are responsible for maintaining the confidentiality of your login credentials (e.g., FaceID, TouchID, password) and for all activities under your account.

No Physician–Patient Relationship

The Service is not a licensed medical provider. Information provided, including nutrition insights, AI recommendations, or personalized menus, is not medical advice and does not establish a physician–patient relationship. Always consult a licensed healthcare provider before making health decisions, especially if you have or suspect a medical condition (e.g., pregnancy, diabetes, heart disorders). We do not guarantee specific outcomes; you use the Service at your own risk.

Professional Qualifications

The Service is supported by nutritionists licensed by the Ministry of Health, holding relevant degrees and specialized experience in nutrition and wellness. Their expertise informs the insights provided; these are for informational purposes only and do not constitute medical advice.

Devices and Software

You are responsible for providing compatible devices, software, and data connections. You consent to automatic or manual updates to the Service and to receiving necessary notifications to maintain functionality.

Subscription and Purchases

The Service may offer free access, subscription plans, in-app purchases, and/or additional paid features, including appointments with licensed nutritionists and requests for personalized menus. Subscription details (price and length) are shown at purchase. Key terms:

• Free Trial: A free trial may be offered, after which your selected plan will begin unless canceled before the trial ends.
• Auto-Renewal: Subscriptions automatically renew for the same period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Payment: Payment will be charged to your Apple ID account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Manage & Cancel: You can manage and cancel subscriptions at any time via your Apple ID Account Settings after purchase. No prorated refunds are provided for unused portions.
• Pricing: Prices are displayed in the app at the time of purchase and may vary by region. We may modify pricing; changes will be communicated via the app or email.
• Promotions: Promotional offers are subject to the terms disclosed at sign-up. After the promotion ends, standard rates apply unless canceled.

Additional Terms: When purchasing through the App Store, the Apple Media Services Terms also apply, including the Apple Standard End User License Agreement (EULA).

Diet Plans Outside the App

We offer personalized diet plans through our website at the following prices (including VAT):

• Basic Plan: ₪400 — Includes basic health tracking and personalized insights.
• Standard Plan: ₪800 — Includes a personalized diet plan and detailed health tracking.
• Premium Plan: ₪1200 — Includes consultation with a licensed nutritionist, a personalized diet plan, and comprehensive health tracking.

All plans are intended for informational purposes only and do not constitute medical advice. Consult a licensed healthcare provider before using the plans.

Refunds for Web Plans

As a company providing services, our refund policy for diet plans through the website is as follows:

• Plans can be canceled for a full refund if canceled within 24 hours of the first meeting, in accordance with Israeli Consumer Protection Law.
• A partial refund is available up to 24 hours before the next meeting, proportional minus 15% of the plan cost, at our discretion.
• Refund requests should be sent to [email protected]. Each request will be reviewed case by case.

We reserve the right to deny refund requests in cases of significant service usage or violation of terms.

Use of the Service

You agree to use the Service for personal, lawful, non-commercial purposes and not to:

• Reverse engineer, modify, decompile, or exploit the Service;
• Engage in illegal activities or harm others;
• Upload unlawful, discriminatory, harmful, defamatory, or infringing content (including nude or sexually suggestive material);
• Transmit viruses, worms, or destructive code.

You are responsible for any content you upload and any resulting legal consequences.

Proprietary / Intellectual Property

All content and functionality of the Service are owned by NSL Nutrition (Naama Sahar Levitt Nutrition) or licensed partners and protected by copyright, trademark, and other intellectual property laws. Unauthorized use is prohibited. User-uploaded content (e.g., photos) grants us a non-exclusive, royalty-free, worldwide license to use, modify, and display such content solely for Service functionality.

Privacy

Please review our Privacy Policy at https://smarteat.co/privacy. By using the Service, you agree to be bound by our Privacy Policy, which is incorporated into these Terms. The Service is hosted in Israel. If you access the Service from regions with different data protection laws, you consent to your data being transferred to and processed in Israel. If you do not agree, you must stop using the Service and contact us at [email protected] to request data deletion.

Limitation of Liability

The Service is provided “as is” without warranties. To the fullest extent allowed by Israeli law, we are not liable for any damages (e.g., health outcomes, data loss) arising from your use. Our aggregate liability shall not exceed USD 100 or the amount you paid, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold us, our affiliates, officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, breach of these Terms, uploaded content, violation of applicable laws, misuse of the Service, or infringement of third-party rights.

Dispute Resolution

These Terms are governed by Israeli law. Disputes will be resolved in Israeli courts. Contact [email protected] for complaints. Claims must be filed within one year, as permitted by law. You agree that, except for claims requiring injunctive relief, any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration conducted in Israel, in accordance with the Israel Arbitration Law, 5728-1968. You waive any right to a jury trial or to participate in a class action lawsuit. Arbitration costs will be shared equally unless otherwise required by law. You agree that any claims against us must be brought individually and not as part of a class, collective, or representative action.

Termination

We may suspend or terminate your access for violating these Terms or applicable laws, or if your use poses a risk to the Service or others.

Disclaimer: Warranty

To the fullest extent permitted by Israeli law, we provide the Service “as-is” without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy. We disclaim liability for errors or omissions in content, downtime, or interruptions in the Service.

Amendments

We may update these Terms at any time. Continued use after changes indicates your acceptance. Review the Terms periodically in the app’s settings.

The app’s UI/UX design was developed by Victoria Skokshina and is owned by NSL Nutrition (Naama Sahar Levitt Nutrition).

Trademarks

All trademarks, logos, and brand names are the property of their respective owners. Use of these marks does not imply endorsement.

Translations & Language Priority

These Terms may be provided in multiple languages for your convenience. In the event of any conflict or inconsistency between translations, the Hebrew version will prevail.
